SCOPE OF APPLICATION<\/strong><\/p>\n\n\n\n<p>These General Terms and Conditions of Sale apply, without restriction or reservation, to any rental of accommodation or bare pitches on the Le Gallo Romain campsite, operated by SARL Camping ROUX, to non-professional customers (&#8220;Customers&#8221; or &#8220;Customer&#8221;), on its website <a href=\"https:\/\/www.legalloromain.com\">https:\/\/www.legalloromain.com<\/a> or by telephone, postal mail, or electronic mail (emails), or at any location where the Service Provider markets the Services.<br><br>The main characteristics of the Services are presented on the website <a href=\"https:\/\/www.legalloromain.com\">https:\/\/www.legalloromain.com<\/a> or in written form (paper or electronic) in the event of a reservation by a means other than a remote order.<br><br>The Customer is required to read them before placing an order. The selection and purchase of a Service is the sole responsibility of the Customer.<br><br>These General Terms and Conditions of Sale apply to the exclusion of all other terms and conditions of the Service Provider, and in particular those applicable to other channels for marketing the Services.<\/p>\n\n\n\n<p>These General Terms and Conditions of Sale are accessible at any time on the website and shall prevail, where applicable, over any other version or any other contractual document. The version applicable to the Customer is the one in effect on the website or communicated by the Service Provider on the date the Customer places the Order.\n\nUnless proven otherwise, the data recorded in the Service Provider&#8217;s computer system constitutes proof of all transactions concluded with the Customer.\n\nUnder the conditions defined by the French Data Protection Act and the European Data Protection Regulation, the Customer has the right, at any time, to access, rectify, and object to all of their personal data, if the processing is not essential to the execution of the order and the stay, as well as their consequences, by writing to:<\/p>\n\n\n\n<p>Campsite Le Gallo Romain \u2013 1090 route du Col \/ 26300 BARBIERES<\/p>\n\n\n\n<p>The Customer declares that they have read and accepted these General Terms and Conditions of Sale, either by checking the box provided for this purpose before completing the online ordering process, as well as the general terms and conditions of use of the website<a href=\"https:\/\/www.legalloromain.com\"> https:\/\/www.legalloromain.com<\/a>, or, in the case of an offline reservation, by any other appropriate means.<\/p>\n\n\n\n<p><strong>ARTICLE 2 \u2013 RESERVATIONS<\/strong><\/p>\n\n\n\n<p>The Customer selects the services they wish to order on the website or in any document sent by the Service Provider, according to the following procedures:\n\n\u00b7 Selection of stay dates\n\n\u00b7 Selection of the number of participants, specifying the ages of the children\n\n\u00b7 Selection of accommodation type\n\n\u00b7 Selection of additional options\n\n\u00b7 Provision of customer and participant contact information\n\n\u00b7 Review and acceptance of the general terms and conditions of sale\n\n\u00b7 Payment of the deposit or the full amount of the stay\n\n\u00b7 Validation or refusal by the Service Provider (resulting in non-payment)\n\n\u00b7 Email confirmation with a stay voucher or invoice.<\/p>\n\n\n\n<p>The order is confirmed when Camping Le Gallo Romain accepts the reservation. An email is sent to the customer specifying that their reservation has been accepted. The reservation is confirmed only after receipt of a 30% deposit (either by credit card, check, bank transfer, or ANCV).<br><br>It is the Customer&#8217;s responsibility to verify the accuracy of the Order and to immediately notify the Service Provider of any errors. The Order will only be considered final after the Service Provider sends the Customer confirmation of acceptance of the Order, by email or post, or by signing the contract in the case of a reservation made directly at the premises where the Service Provider sells the Services.<br><br>Any Order placed on the website <a href=\"https:\/\/www.legalloromain.com\">https:\/\/www.legalloromain.com<\/a> constitutes the formation of a contract concluded remotely between the Customer and the Service Provider.<\/p>\n\n\n\n<p>All Orders are personal and may not, under any circumstances, be assigned or sublet, otherwise they will be void.\n\nMinors must be accompanied by their parents or legal guardians.\n\nThe campsite reserves the right to refuse a guest if they have previously caused damage, violated safety rules, or disrupted the peaceful enjoyment of other guests.<\/p>\n\n\n\n<p><strong>ARTICLE 3 \u2013 PRICES<\/strong><\/p>\n\n\n\n<p>The Services offered by the Provider are provided at the prices in effect on the website <a href=\"https:\/\/www.legalloromain.com\">https:\/\/www.legalloromain.com<\/a>, or on any information medium provided by the Provider, at the time the Customer places the order. Prices are expressed in Euros, excluding and including VAT.<br><br>The prices take into account any discounts that may be granted by the Provider on the website <a href=\"https:\/\/www.legalloromain.com\">https:\/\/www.legalloromain.com<\/a> or on any information or communication medium.<br><br>These prices are fixed and not subject to revision during their validity period, as indicated on the website <a href=\"https:\/\/www.legalloromain.com\">https:\/\/www.legalloromain.com<\/a>, in the email, or in the written proposal sent to the Customer. After this validity period, the offer is void, and the Provider is no longer bound by the prices.<\/p>\n\n\n\n<p>They do not include processing and administration fees, which are charged in addition, under the conditions indicated on the website <a href=\"https:\/\/www.legalloromain.com\">https:\/\/www.legalloromain.com<\/a> or in the information (mail, email, etc.) previously communicated to the Customer, and calculated prior to placing the Order.<br><br>The payment requested from the Customer corresponds to the total amount of the purchase, including these fees.<br><br>An invoice is issued by the Seller and provided to the Customer no later than the time the balance is paid.<\/p>\n\n\n\n<p><strong>3.1. TOURIST TAX<\/strong><\/p>\n\n\n\n<p>The tourist tax, collected on behalf of the Valence, Romans Agglo urban community, is not included in the prices. Its amount is determined per person per night, i.e., \u20ac0.55 for adults. It is payable when paying for the Service and appears separately on the invoice.<\/p>\n\n\n\n<p><strong>ARTICLE 4 &#8211; PAYMENT TERMS<\/strong><\/p>\n\n\n\n<p><strong>4.1. DEPOSIT<\/strong><\/p>\n\n\n\n<p>Advance payments are deposits. They constitute an advance on the total price owed by the Client.\n\nA deposit corresponding to 30% of the total price for the Services ordered is required when the Client places the order. It must be paid upon receipt of the final rental agreement and attached to the copy to be returned. It will be deducted from the total amount of the order.\n\nThis deposit will not be refunded by the Service Provider in the event of cancellation of the stay by the Client less than 20 days before the scheduled arrival date (except as provided for in Article 6.4 of these general terms and conditions).\n\nThe balance of the stay must be paid in full 20 days before the arrival date (otherwise the rental will be canceled).<\/p>\n\n\n\n<p><strong>4.2. PAYMENTS<\/strong><\/p>\n\n\n\n<p>The payments effectued by the Consumer will not be considered as finalLes paiements effectu\u00e9s par le Client ne seront consid\u00e9r\u00e9s comme d\u00e9finitifs only after actual collection of the sums due by the Service Provider.<\/p>\n\n\n\n<p>In case of late paymentIn the event of late payment and payment of the amounts owed by the Client beyond the deadline set above, or after the payment date appearing on the invoice sent to the Client, late payment penalties calculated at the rate of 10% of the total amount including tax for the provision of the Services will be automatically and automatically accrued to the Service Provider, without any formality or prior formal notice.<br><br>Late payment will result in the immediate payment of all amounts owed by the Client, without prejudice to any other action that the Service Provider may be entitled to take against the Client in this regard.<\/p>\n\n\n\n<p><strong>4.3. FAILURE TO RESPECT WITH THE PAYMENT CONDITIONS<\/strong><\/p>\n\n\n\n<p>Furthermore, the Service Provider reserves the right, in the event of failure to respect the payment conditions set out above, to suspend or cancel the provision of the Services ordered by the Client and\/or to suspend the performance of its obligations after formal notice has remained without effect.<\/p>\n\n\n\n<p><strong>ARTICLE 5 &#8211; PROVISION OF SERVICES<\/strong><\/p>\n\n\n\n<p><strong>5.1. PROVISION AND USE OF SERVICES<\/strong><\/p>\n\n\n\n<p>-The pitch may be occupied from 2:00 PM on the day of arrival and must be vacated by 12:00 AM on the day of departure.<br><br>&#8211; The accommodation (mobile home rental) may be occupied from 3:00 PM on the day of arrival and must be vacated by 10:00 AM on the day of departure.<\/p>\n\n\n\n<p><strong>An early arrival supplement of \u20ac20 may be offered for rentals, subject to availability. Your earliest arrival date is 12:00 AM.<br><br>A late departure supplement of \u20ac25 for rentals and \u20ac5 for pitches may be offered. Your latest departure date is 2:00 PM.<\/strong><\/p>\n\n\n\n<p>The balance of the stay must be paid in full 20 days prior to the arrival date (otherwise the rental will be cancelled).\n\nThe accommodations and pitches are intended for a specific number of occupants and may not be occupied by more people under any circumstances.\n\nThe accommodations and pitches must be returned in the same clean condition as upon delivery. Otherwise, the tenant will be required to pay a flat-rate cleaning fee of \u20ac45. Any damage to the accommodation or its accessories will be immediately repaired at the tenant&#8217;s expense. The end-of-rental inventory must be exactly the same as the one at the beginning of the rental period.<\/p>\n\n\n\n<p><strong>5.2. SECURITY DEPOSIT<\/strong><\/p>\n\n\n\n<p>For accommodation rentals, a \u20ac200 security deposit will be required from the Guest:\n\n\u2022 Either by our partner SWIKLY before your stay, electronically, via a credit card imprint, without reducing the payment limit.\n\n\u2022 Or by the Campsite on the day of your arrival, via a credit card imprint.\n\nAfter your departure, we will carry out an inventory and condition report:\n\n\u2022 If everything is in order, SWIKLY or we will simply cancel the credit card imprint.\n\n\u2022 If we notice any material damage or if the accommodation is not left in a properly cleaned condition, we will deduct the amount corresponding to this damage.\n\nThis security deposit does not constitute a limit on liability.<\/p>\n\n\n\n<p><strong>ARTICLE 6 \u2013 DELAY, INTERRUPTION OR CANCELLATION OF STAY BY THE CUSTOMER<\/strong><\/p>\n\n\n\n<p>No discount will be granted in the event of late arrival, early departure or change in the number of people (whether for all or part of the planned stay). In the event of a no-show within 24 hours of the start of the stay and without notification of the customer&#8217;s arrival, the campsite will dispose of the pitch or rental accommodation.<\/p>\n\n\n\n<p><strong>6.1. MODIFICATION<\/strong><\/p>\n\n\n\n<p>In the event of a change in dates or the number of guests, the Service Provider will endeavor to accommodate date change requests as much as possible, subject to availability, without prejudice to any additional costs. In all cases, this is a best-efforts obligation, as the Service Provider cannot guarantee the availability of a pitch or accommodation, or of another date; a surcharge may be charged in these cases.\n\nAny request to reduce the length of stay will be considered by the Service Provider as a partial cancellation, the consequences of which are governed by Article 6.3.<\/p>\n\n\n\n<p><strong>6.2. INTERRUPTION<\/strong><\/p>\n\n\n\n<p>An early departure will not give rise to any reimbursement from the Service Provider.<\/p>\n\n\n\n<p><strong>6.3. CANCELLATION<\/strong><\/p>\n\n\n\n<p>In the event of cancellation of the Reservation by the Customer after its acceptance by the Service Provider less than 20 days before the scheduled Rental date, for any reason other than force majeure, the deposit paid at the time of the Reservation, as defined in Article 4 &#8211; PAYMENT TERMS of these General Terms and Conditions of Sale, will automatically be retained by the Service Provider as compensation and will not give rise to any refund.\n\nIn all cases of cancellation, the processing and management fees (Article 3) will remain the property of the Service Provider.<\/p>\n\n\n\n<p><strong>6.4. CANCELLATION IN CASE OF PANDEMIC<\/strong><\/p>\n\n\n\n<p><strong>6.4.1.<\/strong> In the event of a total or partial closure of the establishment during the dates of the booked stay (which is considered a total or partial ban on public access, to the extent that the Client is directly affected by the application of this measure) decided by the public authorities, and which is not attributable to the Service Provider, the amounts paid in advance by the Client for the stay reservation will be refunded within 20 days.\n\nThe Service Provider shall not, however, be liable for any additional compensation beyond this refund of the amounts already paid for the stay reservation.<\/p>\n\n\n\n<p><strong>6.4.2.<\/strong> By way of derogation from the provisions of Article <strong>6.3 CANCELLATION<\/strong>, any cancellation of the stay duly justified by the fact that the Client would be affected by COVID 19 (infection) or another infection considered to be part of a pandemic, or would be identified as a contact case, and that this situation would call into question his participation in the stay on the planned dates will be made without termination compensation.<\/p>\n\n\n\n<p>Any processing and administration fees as provided for in the general terms and conditions will remain the property of the Service Provider. In all cases, the Customer must provide proof of the event that makes them eligible for this cancellation right.<br><br><strong>6.4.3.<\/strong> By way of exception to the provisions of Article <strong>6.3 CANCELLATION<\/strong>, in the event that the Customer is forced to cancel their stay in full due to government measures preventing participants from traveling (general or local lockdown, travel ban, border closures), even though the campsite is able to fulfill its obligation and accommodate Customers, the Service Provider will refund any amounts paid in advance.<br><br><strong>6.4.4 &#8211;<\/strong> If the Customer has taken out specific insurance covering the risks listed in Article <strong>6.4.2<\/strong> or Article <strong>6.4.3<\/strong>, the insurance compensation received by the Customer will be deducted from the refund amount.<\/p>\n\n\n\n<p><strong>ARTICLE 7 &#8211; CUSTOMER OBLIGATIONS<\/strong><\/p>\n\n\n\n<p><strong>7.1. CIVIL LIABILITY INSURANCE<\/strong><\/p>\n\n\n\n<p>The Client staying on a site or in accommodation must have civil liability insurance. Proof of insurance may be requested from the Client before the start of the service.<\/p>\n\n\n\n<p><strong>7.2. PETS<\/strong><\/p>\n\n\n\n<p>Pets are allowed, under the responsibility of their owners. They are accepted for a fee available from the Service Provider and payable on site.<\/p>\n\n\n\n<p><strong>7.3. INTERNAL RULES<\/strong><\/p>\n\n\n\n<p>Internal regulations are posted at the entrance to the establishment and at reception. Customers are required to read and comply with them. They are available upon request.<\/p>\n\n\n\n<p><strong>ARTICLE 8 &#8211; OBLIGATIONS OF THE SERVICE PROVIDER &#8211; GUARANTEE<\/strong><\/p>\n\n\n\n<p>The Service Provider guarantees the Client, in accordance with legal provisions and without additional payment, against any lack of conformity or hidden defect arising from a fault in the design or execution of the Services ordered.\n\nTo assert their rights, the Client must inform the Service Provider in writing of the existence of defects or lack of conformity within a maximum of 12 hours from the provision of the Services.\n\nThe Service Provider will refund or rectify, or have rectified (where possible), any Services deemed defective as soon as possible and no later than 3 days following the Service Provider&#8217;s discovery of the defect or defect. Reimbursement will be made by crediting the Client&#8217;s bank account or by check addressed to the Client.\n\nThe Service Provider&#8217;s guarantee is limited to the reimbursement of the Services actually paid for by the Client. The Service Provider shall not be held liable or in default for any delay or non-performance resulting from the occurrence of a force majeure event generally recognized by French case law.\n\nThe Services provided through the Provider&#8217;s website https:\/\/www.legalloromain.com comply with the regulations in force in France.<\/p>\n\n\n\n<p><strong>ARTICLE 9 &#8211; RIGHT OF WITHDRAWAL<\/strong><\/p>\n\n\n\n<p>Activities related to the organization and sale of stays or excursions on a specific date or during a specified period are not subject to the withdrawal period applicable to distance and off-premises sales, in accordance with the provisions of Article L221-28 of the Consumer Code.<\/p>\n\n\n\n<p><strong>ARTICLE 10 \u2013PROTECTION OF PERSONAL DATA<\/strong><\/p>\n\n\n\n<p>The Service Provider, the drafter of this document, implements personal data processing activities based on the following legal basis:\n\n\u25cf Either the legitimate interest pursued by the Service Provider when it pursues the following purposes:\n\n&#8211; prospecting\n\n&#8211; managing relationships with its clients and prospects,\n\n&#8211; organizing, registering for, and inviting clients to the Service Provider&#8217;s events,\n\n&#8211; processing, executing, prospecting, producing, managing, and monitoring client requests and files,\n\n&#8211; drafting documents on behalf of its clients.\n\n\u25cf Or compliance with legal and regulatory obligations when it implements processing activities for the following purposes:\n\n&#8211; preventing money laundering and the financing of terrorism and combating corruption,\n\n&#8211; invoicing,\n\n&#8211; accounting.<\/p>\n\n\n\n<p>The Service Provider only retains data for the duration necessary for the operations for which it was collected, and in compliance with applicable regulations.\n\nIn this regard, customer data is retained for the duration of the contractual relationship plus three years for marketing and prospecting purposes, without prejudice to retention obligations or limitation periods.\n\nFor the prevention of money laundering and terrorist financing, data is retained for five years after the end of the relationship with the Service Provider.
